General terms and conditions of Ausma Glas & Kozijnen

This is a translation of the Dutch text. In case of any discrepancy, the Dutch version prevails.

1. Applicability

These general terms and conditions apply to all quotes, agreements, deliveries, installation work, requests via the website and other services of Ausma Glas & Kozijnen.

2. Website use and information on the website

The information on this website is intended as general information. No binding rights can be derived from the texts, images, price estimates, impressions or calculation examples shown, unless expressly confirmed otherwise in writing.

3. Quote requests and price estimates

Quote requests via the website, email, phone or other channels are without obligation, unless stated otherwise in writing. Online calculators, guide prices and price estimates are intended solely as a rough estimate.

A final price only becomes binding once Ausma Glas & Kozijnen has issued a quote or order confirmation in writing and this has been accepted.

4. Formation of the agreement

An agreement is formed as soon as a quote or order has been accepted in writing, or as soon as Ausma Glas & Kozijnen starts preparation, ordering, delivery or installation at the customer's request.

5. Measuring and information from the customer

The customer is responsible for providing correct and complete information in good time about the location, accessibility, particulars and dimensions, insofar as these have not been measured or determined by Ausma Glas & Kozijnen itself.

6. Delivery of products

Window frames, glass, doors, sliding doors and related products are delivered in accordance with the quote, order confirmation and product specifications. Images, colours, textures and finishes on the website or in samples may differ from the final delivery.

7. Installation work

Installation is carried out on the basis of the agreed work, the situation on site and the information provided by the customer. The customer ensures that the work area is accessible, safe and workable.

8. Additional work and unforeseen situations

If, during delivery or installation, it turns out that additional work, adjustments, repairs or extra materials are needed, this may be classed as additional work and charged separately.

9. Prices and payment

Unless stated otherwise, all prices quoted exclude VAT. Extra costs resulting from different situations, changes, unforeseen circumstances or additional work may be charged.

Payment is made in accordance with the quote, invoice or the agreed payment terms. If payment is not made, execution may be suspended.

10. Delivery times and planning

Stated delivery times and schedules are indicative, unless agreed otherwise in writing. Delays caused by suppliers, weather conditions, unforeseen situations or circumstances beyond our control do not in principle give rise to a right to compensation.

11. Custom work and cancellation

Products that are ordered or produced specially to size or to the customer's specifications cannot in principle be cancelled free of charge once production or ordering has started.

12. Completion and complaints

The customer must check delivered products and completed work as soon as possible. Complaints about visible defects must be reported in writing within a reasonable period after discovery.

13. Warranty

Products and installation are only covered by the warranty as agreed in writing or as follows from the relevant supplier, manufacturer or order confirmation.

The warranty does not cover normal wear, incorrect use, insufficient maintenance, damage by third parties or changes made without permission.

14. Liability

Our liability is limited to direct damage that is the direct result of an attributable shortcoming, insofar as permitted by law. Liability for indirect damage, consequential damage or loss of profit is excluded, unless there is intent or deliberate recklessness.

15. Force majeure

In the event of force majeure, Ausma Glas & Kozijnen is not obliged to fulfil its obligations for as long as the situation continues. Force majeure includes, among other things, supply problems, illness, extreme weather conditions, traffic obstructions, government measures and disruptions beyond our control.

16. Applicable law and contact

Dutch law applies to these terms and conditions and to all agreements. For questions about these general terms and conditions, please contact us at info@ausmaglasenkozijnen-veenendaal.nl.
